DIRECTED WORK - “Hack back” techniques by police authorities: necessary and legitimate?
To strengthen the position of the police in the fight against serious crimes, several governments have passed legislation giving police services new investigative powers. These laws are controversial since they allow hacking into computers, installing spyware and remote monitoring. This is how the present work takes place. It will be a question of studying the techniques of legal hacking by the police authorities. These are legal powers recently granted to police authorities in several countries such as the Netherlands, the United States, Australia and Germany. Therefore, the question is whether the investigative power of hacking helps solve a crime by providing evidence that can be used in court. If not, i.e. where the hacking is unlikely to aid a criminal investigation, the proposed investigative power would likely be an abuse of power. Thus, it seems important to look at the use of legal hacking techniques by police authorities where the practice is legal in order to answer the question.
