THESIS - Analysis of Sentencing Factors According to Judges for Child Pornography Cases in Canada

The study aims to understand the decision-making process of judges when determining the sentence in JP cases in Canada, based on an analysis of the legal and penal circumstances on which they are based. The sample is made up of 173 written judgments mentioning the sentences imposed by the judges during the trials, for YP offenses committed between 1999 and 2019. The various analyzes carried out show a certain increase in the severity of the prison sentences. over the years. Despite the addition of a mandatory minimum sentence from 2012, the results suggest that certain aggravating circumstances mentioned during the trial vary the severity of the sentence. This study provides the first assessment of sentencing factors for child pornography accused in Canada.
